DECLARACIÓN POLÍTICA DE LOS PUEBLOS INDÍGENAS ! (DECLARATION OF INDIGENOUS PEOPLES POLICY) in Mexico

2012 ELECTORAL PROCESS

Indigenous representatives from 23 States, 57 indigenous people, gathered in the heart of Mexico, called by the national indigenous movement under the theme: "The Agenda of indigenous peoples in the 2012 election process", took the floor to express our positions and our peoples about the 2012 election process, y:

WE DECLARE:

At the time of the conquest, were massacred more than 6 million indigenous people by the Spaniards in a period of 10 years.

At that time, there were more than 350 indigenous peoples and throughout the territory of the new Spain was indigenous, today we are only 62 people with 86 indigenous languages, and one-fifth of the Mexican territory; However, in the war of independence, 80% of the liberating army was composed of natives of all peoples; in the revolution, the army was also mostly indigenous, but we were not considered in the Constitution of 1917, and; in 1994, again, the Indians appeared "peace" to demand the rights of indigenous peoples.

Today, we are at a moment in which the indigenous peoples of Mexico in a new phase of coordination and strengthening of the struggles and movements of our peoples and their organizations, recognizing that the unit is a necessity to make us visible with the majority, national society and the world, as well as to secure political positions of claim and development proposals with a State that has historically denied our rights and our existence.

At this juncture of reunion and rearticulation, is the commitment to fight for the recognition of indigenous peoples as subjects of public law, in order to pave the way for the recognition and enforcement of the historical rights of indigenous peoples, among which it is necessary to highlight:

Includes also the Agenda national indigenous demands and approaches of an important part of indigenous peoples, and on the other, the necessary and forced response that we demand of the Mexican State in its three branches of Government: federal, State and municipal government, as well as in the scope of the powers of the State: Executive, legislative and judicial, to new challenges with the Mexican State.

It is opportune to highlight our concern by the apparent absence of commitments of the candidates and the candidate to the Presidency of the Republic, in his vision of how the relationship of the winner or winner will be dealt with indigenous peoples.

It is worrying to see us just as vulnerable groups or simple beneficiaries of crumbs public, since we are societies that we give origin to the Mexican nation and according to the political Constitution of the Mexican United States and international law give support to the country, because of its natural, strategic, political, social, cultural or linguistic wealth.

No one can pass without acknowledging our territorial, political and economic rights in a relationship of equals, where men and women abonemos in the strengthening of the Republic.

Therefore you can not forget the slope of the implementation of the agreements reached at the poor Samkamchen, Chiapas.

Nor is set aside the repression, disappearances, harassment, imprisonment, dispossession, that are subject to our communities, representatives and indigenous leaders who defend their territories.

Highlight countless cases in defense of the territory and natural resources between these, in the fight against mining companies, projects, real estate, water, springs, forests, projects ecotourism in Oaxaca, Guerrero, Morelos, Hidalgo, Puebla, to mention a few.

It is the case of the fight against mining, in Wirikuta sacred site; in Oaxaca and Guerrero against Canadian mining companies, or harassment of the INAH to township Tehuipango Nahuatl to defend its Ceremonial Center.

Or the injustice towards women as the nahuas from Guerrero and Veracruz, to mention some examples, such as the of the Mrs Ernestina Ascencio, killed by military rape in the Sierra of Zongolica, Veracruz.

Also the case of activist Petra Martínez, killed along with his son and grandson of 5 years in the framework of the program "Morelos insurance" in Morelos.

The demands of indigenous peoples are immense but emblematic way the basics are:

FIRST.-the right to land and territory. This implies that the federal, State and municipal Government not must grant concessions on mining, water, forests and other resources that exist in the territories of indigenous peoples, for this must undergo consultation - free, prior and informed - indigenous peoples involved, and in the very specific case of communication, giving indigenous peoples a 30% of the radio spectrum, under the principle of respect for the airspace that is us.

SECOND.-full exercise of self-determination and autonomy in indigenous peoples, within the framework of the provisions of Convention 169 of the ILO, of the Declaration of the rights of indigenous losPueblos. The autonomy of the indigenous peoples of Mexico, is not go against national unity, nor intended to independence or separation, on the contrary, it is the best way to resolve the historical shortcomings of indigenous peoples. Urgent constitutional reforms to link the rights of indigenous peoples with agreements, conventions and international declarations concerning indigenous peoples.

THIRD.-full political representation of indigenous peoples, men and women, and their participation in the definition and implementation of public policies with regard to their peoples, by the orders of federal, State and municipal government, as well as in the Executive, legislative and judicial powers. A real representation in the Congress of the Union with the creation of indigenous constituency VI with 75 federal deputies and 20 indigenous senators, men and women, as well as the recognition of the IV level of Government.

Fourth.-a new relationship of mutual respect and recognition between indigenous peoples with the Mexican State. Input, this calls for a reform of the Act establishing the Commission and its internal policy instruments, to eliminate bureaucratic and legal entry barriers; the redefinition of the indigenous education - from initial to higher - for indigenous peoples, as well as the implementation of Intercultural education to the educational system of Mexico.

Fifth.-the indigenous women need special attention in health, justice, education and culture. She is the bearer of the identity and philosophy of our peoples, therefore, the policy for indigenous women should be created, directed and applied the same porellas. Constitutional reforms will be the new Congress of the Union's commitment to protect and fulfil the rights of indigenous women in Mexico.

Indigenous women claim, guarantee and respect of fundamental rights, particularly concerning the rights to a life free of violence, as well as the access to justice in a free and efficient manner in an intercultural context.

Who will obey and respect international instruments (CEDAW, Convention 169 of the ILO, the UN Declaration on the rights of indigenous peoples, to Belém) relating to peoples and indigenous women, as well as the recommendations of the permanent indigenous Forum of the United Nations and the Inter-American Commission on human rights.

Free, free and quality access to health services that still do not guarantee the life from curable disease and preventable of women, elderly women, girls and indigenous children; also, the immediate commitment to ensure access to the intercultural education of quality that include sexual and reproductive health issues, comprehensible and accurate manner.

Larger spaces for political participation of women based on gender parity and gender equality in the decision-making process.

We highlight as a fundamental part in our demands, linguistic, cultural and social rights, giving identity to our peoples.

SIXTH.-we propose a constructive dialogue between the different political actors of our peoples, as well as open space for meeting and dialogue with other societies that make up the Mexican society and the world.

SEVENTH.-we demand that the federal and State Governments, as well as to the Chamber of deputies of the Congress of the Union, and local congresses, the allocation of a budget adequate and realistic in proportion to our contribution to the Mexican nation, every time that our land is exploited oil, many of our lands have been flooded for the construction of hydroelectric dams and they exploit strategic resources that provide sufficient wealth to Mexico, but not as well to indigenous peoples.

EIGHTH. We ask the candidates to the Presidency of the Republic, candidates for deputies and senators who met his word with indigenous peoples, once they are elected, or are they responsible for that polls are not installed in the indigenous territories in the next election;

9Th.-We call to the President-elect or President elected, members and senators, which in 100 days from 1 July this year, to instances that serve indigenous peoples be assigned profesionlaes indigenous with broad moral solvency and knowledge of the indigenous otherwise political agenda, there will be no political will.
We are by:

Respect for the autonomous exercise of Regional Coordinator of Community authorities (CRAC), community policing of the mountain and costa chica of Guerrero.

Support for the indigenous community of Cherán, Michoacán in the exercise of autonomous rights.

We demand respect for Wirikuta sagrado-espiritual territory of the Wirrarikas brothers.

That the ceremonial centres under the administration of the INAH, pass into the hands of the indigenous peoples

Support for the indigenous peoples of Oaxaca, Guerrero, Chiapas, Michoacán and San Luis Potosí who fight against the invasion of wind energy-generating and mining companies.

Our total support for the right to the restoration of the territory of the Yaqui tribe.

The recognition of the rights of Afro brothers.

Restitution of land to indigenous peoples native to Baja California, currently overrun by international companies.

PROCESO ELECTORAL 2012

Representantes indígenas de 23 estados, de 57 pueblos indígenas, reunidos en el corazón de México, convocados por el Movimiento Indígena Nacional bajo el tema: “La Agenda de los pueblos indígenas en el proceso electoral 2012”, tomamos la palabra para expresar nuestras posiciones y la de nuestros pueblos acerca del proceso electoral 2012, y:

DECLARAMOS:

En la época de la Conquista, fuimos masacrados más de 6 millones de indígenas por los españoles en un período de 10 años.

En ese entonces, éramos más de 350 pueblos indígenas y todo el territorio de la Nueva España era indígena, hoy sólo somos 62 pueblos con 86 lenguas indígenas y, con una quinta parte del territorio mexicano; no obstante a ello, en la Guerra de Independencia, el 80% del ejército libertador estaba compuesto por indígenas de casi todos los pueblos; en la Revolución, también el ejército era mayoritariamente indígena, pero no fuimos considerados en la Constitución de 1917, y; en 1994, nuevamente, los indígenas irrumpimos la ”paz” para exigir los derechos pueblos indígenas.

Hoy, nos encontramos en un momento en el que los pueblos indígenas de México en una nueva etapa de coordinación y fortalecimiento de las luchas y movimientos de nuestros pueblos y sus organizaciones, reconociendo que la unidad es una necesidad para visibilizarnos ante la sociedad mayoritaria nacional y el mundo, así como fijar posturas políticas de reivindicación y propuestas de desarrollo ante un Estado que ha negado históricamente nuestros derechos y nuestra existencia.


En esta coyuntura de reencuentro y de rearticulación, está el compromiso de luchar por el reconocimiento de los pueblos indígenas como sujetos de derecho público, a fin de allanar el camino para el reconocimiento y cumplimiento de derechos históricos de los pueblos indígenas, entre los que es necesario destacar:

Incluye además la Agenda Nacional Indígena demandas y planteamientos de una parte importante de los pueblos indígenas, y por la otra, la respuesta necesaria y obligada que exigimos del Estado mexicano en sus tres órdenes de gobierno: federal, estatal y municipal, así como en el ámbito de los poderes del estado: ejecutivo, legislativo y judicial, ante los nuevos retos con el estado mexicano.

Es oportuno destacar nuestra preocupación por la evidente ausencia de compromisos de los candidatos y la candidata a la presidencia de la República, en su visión de cómo se abordará la relación del triunfador o triunfadora con los pueblos indígenas.

Es preocupante que nos vean solo como grupos vulnerables o simples beneficiarios de migajas públicas, cuanto que somos sociedades que damos origen a la Nación Mexicana y de acuerdo a la Constitución Política de los Estados Unidos Mexicanos así como al derecho internacional damos soporte al país, por su riqueza natural, estratégica, política, social, cultural o lingüística.

Nadie puede pasar sin reconocer nuestros derechos territoriales, políticos y económicos en una relación de iguales, donde hombres y mujeres abonemos en el fortalecimiento de la República.

Por ello, no puede olvidarse el pendiente del cumplimiento de los Acuerdos alcanzados en Samkamchén de los Pobres, Chiapas.

Tampoco se puede dejar de lado la represión, desaparición hostigamiento, encarcelamiento, despojo, de que son objeto nuestras comunidades, representantes y dirigentes indígenas quienes defienden sus territorios.

Resaltan innumerables casos en defensa del territorio y los recursos naturales entre estos, de lucha contra las mineras, proyectos inmobiliarios, de agua, manantiales, bosques, proyectos ecoturísticos en Oaxaca, Guerrero, Morelos, Hidalgo, Puebla, por mencionar algunos.

Es el caso de la lucha contra la minería, en Wirikuta por el sitio sagrado; en Oaxaca y Guerrero contra las mineras canadienses, o el acoso del INAH hacia el municipio Náhuatl de Tehuipango por defender su Centro Ceremonial.

O la injusticia hacia las mujeres como el de las nahuas de Guerrero y Veracruz, por mencionar algunos ejemplos, como el de la señora Ernestina Ascencio, muerta por violación de militares en la Sierra de Zongolica, Veracruz.

También el caso de la activista Petra Martínez, asesinada en Morelos junto con su hijo y nieto de 5 años en el marco del Programa “Morelos Seguro”.

Las exigencias de los pueblos indígenas son inmensas pero de manera emblemática exponemos los puntos básicos:

PRIMERO.- Derecho a la tierra y al territorio. Esto implica que el gobierno federal, estatal y municipal no deben otorgar concesiones sobre explotación minera, aguas, bosques y otros recursos que existen en los territorios de los pueblos indígenas, para esto deben someterse a consulta –libre, previo e informado- a los pueblos indígenas involucrados, y en el caso muy concreto de la comunicación, asignar a los pueblos indígenas un 30 % del espectro radioeléctrico, bajo el principio de respeto al espacio aéreo que nos corresponde.

SEGUNDO.- Ejercicio pleno de la Libre Determinación y la Autonomía en los pueblos indígenas, en el marco de lo establecido en el Convenio 169 de la OIT, de la Declaración de la ONU de los derechos de losPueblos Indígenas. La Autonomía de los pueblos indígenas de México, no es ir en contra de la unidad nacional, ni pretende la independencia o separación, por el contario, es la mejor forma de resolver las carencias históricas de los pueblos indígenas. Urgen las Reformas Constitucionales para vincular los derechos de los pueblos indígenas con los Acuerdos, Convenios y Declaraciones Internacionales referentes a los pueblos indígenas.

TERCERO.- Plena representación política de los pueblos indígenas, de hombres y mujeres, y su participación en la definición y aplicación de políticas públicas con respecto a sus pueblos, en los órdenes de gobierno federal, estatal y municipal, así como en los poderes ejecutivo, legislativo y judicial. Una real representación en el Congreso de la Unión con la creación de VI Circunscripción Indígena con 75 diputados federales y 20 Senadores indígenas, hombres y mujeres, así como el reconocimiento del IV Nivel de Gobierno.

CUARTO.- Nueva relación de respeto y reconocimiento mutuos entre los pueblos indígenas con el Estado mexicano. De entrada, esto exige una reforma inmediata a la ley que crea la CDI y a sus instrumentos normativos internos, para eliminar los obstáculos burocráticos y legales de acceso; la redefinición de la Educación Indígena –desde inicial hasta la superior- para los pueblos indígenas, así como la aplicación de la Educación Intercultural a todo el Sistema Educativo de México.

QUINTO.- La mujer indígena debe tener especial atención en la salud, justicia, educación y cultura. Ella es la portadora de la identidad y filosofía de nuestros pueblos, por ello, la política para las mujeres indígenas debe ser creada, dirigida y aplicada porellas mismas. Será compromiso del nuevo Congreso de la Unión las reformas Constitucionales para proteger y cumplir los derechos de las mujeres indígenas de México.

Las mujeres indígenas reclamamos, la garantía y respeto de los derechos fundamentales, sobre todo, referente a los derechos a una vida libre de violencia así como el acceso a la justicia de manera gratuita y eficiente en un marco intercultural.

A que se cumpla y respete los instrumentos internacionales (CEDAW, CONVENIO 169 DE LA OIT, Declaración de la ONU sobre los Derechos de los Pueblos Indígenas, Belem do Para) relativos a pueblos y mujeres indígenas, así como las recomendaciones del Foro Permanente Indígena de Naciones Unidas y de la Comisión Interamericana de Derechos Humanos.
El acceso libre, gratuito y de calidad a los servicios de salud que aún no garantizan la vida por enfermedades curables y prevenibles de las mujeres, ancianas, niñas y niños indígenas; también, el inmediato compromiso en asegurar el acceso a la educación intercultural de calidad que incluyan, temas de salud sexual y reproductiva, clara y precisa.

Mayores espacios de participación política de las mujeres en función de la paridad e igualdad de género en la toma de decisiones.

Destacamos como parte fundamental en nuestras demandas, los derechos lingüísticos, culturales y sociales, que dan identidad a nuestros pueblos.

SEXTO.- Proponemos un diálogo constructivo entre los diferentes actores políticos sociales de nuestros pueblos, así como abrir el espacio para encuentro y diálogo con las otras sociedades que componen la sociedad mexicana y del mundo.

SÉPTIMO.- Exigimos a los gobiernos federal y estatales, así como a la Cámara de Diputados del Congreso de la Unión, y Congresos Locales, la asignación de un presupuesto suficiente y realista en proporción a nuestra contribución a la nación mexicana, toda vez que en nuestras tierras se explota el petróleo, muchas de nuestras tierras se han inundado para la construcción de presas hidroeléctricas y en ellas se explotan recursos estratégicos que aportan suficiente riqueza a México, pero no así a los pueblos indígenas.

OCTAVO. Reclamamos a los candidatos a la presidencia de la república, a los candidatos a diputados y senadores que cumplan su palabra con los Pueblos Indígenas, una vez que sean electos, o serán ellos los responsables que no se instalen urnas en los territorios indígenas en las siguientes elecciones;

NOVENO.- Emplazamos al Presidente Electo o a la Presidenta Electa, a los Diputados y Senadores, que a los 100 días posteriores al 1° de julio del presente año, que las Instancias que atienden a los pueblos indígenas, sean asignadas profesionlaes indígenas con amplia solvencia moral y conocimiento de la agenda política indígena, de lo contrario, no habrá voluntad política.
Nos pronunciamos por:

El respeto al ejercicio autonómico de la Coordinadora Regional de Autoridades Comunitarias (CRAC), policía comunitaria de la montaña y costa chica de Guerrero.

El apoyo a la comunidad indígena de Cherán, Michoacán en el ejercicio de los derechos autonómicos.

Exigimos respeto a Wirikuta territorio sagrado-espiritual de los hermanos Wirrárikas.

Que los Centros Ceremoniales bajo la administración el INAH, pasen a manos de los pueblos indígenas

El apoyo a los pueblos indígenas de Oaxaca, Guerrero, Chiapas, Michoacán y San Luis Potosí que luchan ante la invasión de las empresas mineras y generadoras de energía eólica.

Nuestro apoyo total al derecho de la restauración del territorio de la tribu Yaqui.

El reconocimiento de los derechos de los hermanos afro-descendientes.

Restitución de las tierras a los pueblos indígenas nativos de Baja California, actualmente invadidos por empresas internacionales.
